Waiver and Release Form

Please READ the waiver below and fill out the required fields in the following form sections. All liability language from the waiver will apply to all persons listed below.

I hereby agree as follows:

In consideration of CrossEyed Rides LLC (here in referred to as Service Provider)., in furnishing services and/or equipment to enable me and/or my minor child(ren) to participate in any and all: activities by, events by, sponsored by, ran by, or services provided by CrossEyed Rides LLC., including but not limited to petting, mounting, riding, escorting, monitoring, leading, showing, grooming, or feeding of horses, pony’s, mules, (here in referred to Services).

I, , hereby confirm that there are health and safety risks associated with these types of activities. I therefore assume all risk of injury and/or death associated with these events and I will not hold the event organizers, sponsors, or anyone affiliated with them liable under any circumstances for these events.

I hereby confirm that I, as well as my child(ren), and any other child(ren) I have with me, am/are in good physical condition and do not suffer from any disabilities or physical conditions that places them, me or others at risk or would otherwise prohibit safe participation in this event.

I UNDERSTAND the potential dangers my child(ren) and I could incur resulting in SERIOUS INJURY, or perhaps even DEATH to me, and my child(ren), or anyone else caused by, or incidental to, my electing to participate in the event or activities while mounting, riding, escorting, monitoring, spotting a rider, leading, showing, grooming, or feeding said horse(s); including, but not limited to possible, allergy to horse and/or grooming and saddle care chemicals, bites, kicks, steps or stomps, knocked down, head butts, trips, bucks, and falling off horse whether horse is bucking, flipping, or spooked.

I ACKNOWLEDGE that the events activities carry with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I understand and agree that it is my responsibility to assess the hazards presented in our participation in the event and activities. Hazards could include but are not limited those caused by terrain, facilities, temperature, weather, condition of participants equipment, vehicular traffic, lack of hydration, actions of other people, actions of other animals, or my failure to understand any equine professional’s directions relating to my riding or otherwise use and control, or lack thereof, of the horse I have been assigned to. I further acknowledge and agree that I accept the potential risk of harm that may exist from such.

I hereby ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH CrossEyed Rides LLC, including by way of example and not with limitation any risks that may arise from negligence or carelessness on the part of the persons’ or entities being released; relating to injuries known, unknown, or otherwise not herein disclosed; from dangerous or defective equipment, animals, or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I, , as the undersigned on my own behalf and on behalf of my listed minor children of whom I am a legal guardian, have READ and UNDERSTAND the dangers, ACKNOWLEDGE the risks, and ASSUME all such risks and responsibilities. I freely and voluntarily waive and release, protect, defend, indemnify, hold harmless and forever discharge CrossEyed Rides LLC, CrossEyed Ranch DBA, CharlieAnn Green, the owner of the facility in which the event or activities used, volunteers, agents, sponsors, servants, employees, officers, directors, affiliates, successors and assigns, and their respective heirs, representatives, legal counsel, licensees and all persons, firms, corporations liable or who might be liable, whether or not herein named, none whom admit any liability to the undersigned, but all expressly denying liability (herein the “Released Parties” and collectively with I the “Parties”), from any and all claims, of loss of, or damage to, any demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, which I have or may hereafter have, arising from or in any way relating to me, or my child(ren)’s participation in any of the events or activities conducted by the Released Parties on the date that the events or activities is/are used, on the premises of the Released Parties, or for the benefit of the Released Parties.

I acknowledge that I have read, understand, acknowledge, and fully agree to the terms of this WAIVER AND RELEASE and its contents. I understand and confirm that by signing this WAIVER AND RELEASE, I have given up considerable future rights. I have signed this WAIVER AND RELEASE voluntarily, under no duress or threat of duress, without inducement, promise, or guarantee being communicated to me. My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 years of age or older and mentally competent to enter into this waiver.
